Microsoft invests $300 million in new Barnes & Noble 'strategic partnership'

Image

Well, that's an interesting end to all those legal tussles. Microsoft and bookseller Barnes and Noble have decided to buddy-up in the face of competitors like Amazon and Apple. The strategic partnership -- Microsoft loves 'em -- would come in the form of a new Barnes and Noble subsidiary that deals with all things Nook, in addition to its education business. The bookseller would hold onto the lion's share at 82.4 percent, with the remaining 17.6 percent in Microsoft's control. The first benefit posited would be a Nook app for the incoming Windows 8. Barnes and Noble's Nook Study software would also benefit from a friendly boost on all that Windows hardware. Maybe all those other legal matches will resolve in similar warm-and-fuzzy business hook-ups -- but we doubt it.

Meghan McCain Rips Greta Van Susteren for Inviting Lindsay Lohan to White House Dinner

Meghan McCain bashed Fox News' Greta Van Susteren on Twitter Friday for inviting Lindsay Lohan to this weekend's White House Correspondents' Association dinner.

Not just for the sake of hating on Lohan, a la Rosie O'Donnell.

“Let me get this straight,” Meghan McCain, 27, tweeted. “Greta Van Susteren is bringing Lindsay Lohan to the WHC Dinner but has a moral offense to Louie C.K?”

Meghan McCain Pic

In March, Van Susteren called for a boycott of the Radio/TV Correspondence Dinner over comedian C.K.'s past controversial statements about women.

"The headliner of this year’s Radio and Television Correspondents Dinner is “comedian” Louis C.K. Comedian? I don’t think so. Pig? yes," she wrote.

"He uses filthy language about women. Yes, the C word…and yes, even to describe a woman candidate for Vice President of the United States. It isn’t just Governor Palin he denigrates. He denigrates all women and looks to the crowd to laugh."

Apparently Megs isn't offended ... except by Greta. The daughter of U.S. Sen. John McCain may not be crazy about Lindsay attending, but she's still going.

The Republican blogger, columnist and author Tweeted that she's "headed to DC for the nerd prom." Just hope they don't seat her with Greta or LiLo.

NZXT's Cryo E40 laptop cooler sends a pleasant breeze wherever you like

NZXT is pretty good when it comes to avoiding unnecessary flourishes and providing straight-up PC hardware. Its Cryo E40 laptop cooler is no different, forgoing HDD slots and magic elixirs in favor of two 80mm fans that clasp magnetically to the underside of its steel mesh. These can be plucked off and moved around to suit your lappie's particular hotspots -- so long as you're using a 15-incher or smaller. The E40 rises to 60mm above the surface of your desk, covers an area 420mm wide by 300mm deep, and is powered via a USB cable that can also be shifted to the left or right to suit your ports. The price of all this flexibility? That'd be $28, please, with availability from next month.

Tech Investors Dive Into Adrian Grenier?s New Beer Startup, Churchkey

Adrian-Grenier-flat-top-beer (2)Old movie buffs (and older readers) may remember a time when beer was sold in steel cans that were opened with a "church key." Entourage star Adrian Grenier is tapping into that nostalgia, we hear, with a new beer startup he's cofounding, Churchkey Can Co. The cans are the old-timey variety that you probably haven?t seen since the 60s. They?re made of fully-recyclable steel, and require a churchkey opener to get into. You puncture one corner of the top, then make a deeper puncture on the other side to drink out of. Ever noticed a triangle-shaped piece of metal on the other end of some bottle openers? It?s for these types of cans.

Improving The Metric System - Education - EzineMark

The International System of Units (SI) proved itself very useful to humanity both in commerce and science; it has systematized our lives ever since it was introduced back in the 60?s, so to speak. When the whole world accepted this system as a standard measuring tool, economy and development communicated without boundaries everywhere! As such everyone was using the same unit to measure things (e.g. the meter-kilogram and second rule). The world?s leading scientists and mathematicians came together to create the SI system and it had remained flawless for over 5 decades. However, little do we know that the metric or SI is not perfect and in fact it is being calibrated every decade or so. The brains working behind the scenes are the meteorologists from all over the world and they estimate that about 10% of the SI system is being improved every 15 years or so.

This on-going calibration is essential to scientific research and development programs, because it makes our electronic measuring gadgets extremely accurate.

Over the next 10 years we might be able to witness a dramatic change to the SI system since the Metric Treaty was signed in 1875. Proponents of this change argue that the artifact locked in a vault in Paris may not ultimately represent the unit of mass which is the kilogram. This creates a problem for the whole scientific community. Apparently, what defines the ?kilogram? is just a metal ball that scientists designated as 1 kilogram. The kilogram is the only unit of measurement left unchanged in the SI system, and it is because it is represented by a physical artifact. Back in the 1960?s the 1 meter length bar was replaced by the measurements on the properties of light. The real problem with that chunk of metal is that its mass might change over time; moreover we might not be able to determine the exact difference since we based our weight measurement on it.

Experts found new evidence that the artifact might be losing approximately 50 micrograms per century, but other scientists believe that it may have shed more than 20 times the calculated amount. With this much is at stake it is likely that the artifact will be stored as a museum display instead of being something useful. This causes a great deal for concern and confusion as scientists and experts attempt to mitigate the repercussions. The proper solution therefore is to formulate all standards of measurement based on the fundamental laws of physics, as it has become apparent that flaws might be inevitable if experiments are done in a laboratory. And where to find such competent laboratories is another question. New theories such as quantum physics have also helped contribute to the push for change in the SI system.

Thanks largely to the work of Brian David Josephson (Josephson Effect) and Edwin Herbert Hall (Hall Effect), measuring resistance and voltage became highly accurate even at quantum levels. Semiconductor manufacturers are now able to create electrical instruments that can measure things on the quantum plane than the current SI units. The research of Josephson and Hall enabled scientists to measure mass in electrical quantities; they did this by matching mechanical power (force ? velocity) against electrical power (current ? voltage). We now possess the knowledge to calculate mass with enough accuracy that replacing the ?kilogram artifact? in Paris is a workable deal. If we look back at history we?ll find that the SI has been transformed from its principles in standards of measurements in physical objects to the core functions of nature itself. An example of this is when the length ?meter? was defined in terms of the actual speed of light back in 1983.

The electron charge, e, and Planck constant, h, are both also being considered to be the official units to define the kilogram and electrical quantities. Meanwhile the Boltzmann and Avogadro constants may replace (kelvin) on measuring temperatures as well as the unit of matter which is (mole). Rest assured that these changes won?t come lightly, because the international metrology community is very strict about it. It will be studied and debated upon and a lot of technical issues need to be resolved first before this change can be implemented and the estimated target date is 2015.

Insta-Double For Instagram Investors ? Eyeballs 2.0 | Kid Dynamite's ...

  • Posted by kid dynamite
  • on April 10th, 2012

My friend Ted channeled his inner headline writer and demanded that I write a post about Facebook?s billion dollar acquisition of Instagram titled ?insta-double for Instagram investors.? ? For those unaware, Instagram closed a $50 MM funding round last week which valued them at $500 MM.?? So investors did indeed double their money over the weekend.

This whole deal makes me feel like a dinosaur.?? Look, I don?t record the nightly news on a VHS tape or anything (shout out, Dad!), and I know how to use a computer.? I stream music via Pandora and internet radio, and if you gave me a cassette tape I wouldn?t have any way to play it.?? Which is to say, I?m not a Luddite living in the analog world refusing to adapt to technology.?? But I do remember the internet bubble, and of all of the recent deals bringing monstrous valuations to web based companies, this one flummoxes me the most.? As I wrote last night on Twitter:

There are a number of high flying web-centric companies currently occupying investors and traders minds.?? I?m not a fan of any of them, but I can understand how, given a few lucky breaks and innovations, they each might somehow manage to grow into their valuations.? POSSIBLY.?? Some day.?? While none of these companies have impenetrable barriers to entry, most of them actually do have revenue models, and do make some kind of money.

$GRPN:? targeted ?coupons? (I know, I know: ?Deals!?) for the internet age.

$NFLX: streaming video

$P: streaming music

$ZNGA: online games

$LNKD: job search/recruiting (you?re not the customer ? you?re the product!)

$YELP: community based (supposedly) higher quality reviews

Then, of course, there?s Instagram, which, seriously,? puts sepia tints and thick black borders around squared picture mail.?? As far as I can tell, there is no revenue model, and no threat of any sort of revenue model.??? I can see $LNKD getting more employers to pay to see your information so that they can hire you.? I can see $ZNGA getting people to spend some money to upgrade their gaming experience.? I can see $NFLX getting people to continue to pay for content delivery.?? I can see $GRPN possibly leveraging real-time deals with the new Twitter-centric world (although I?m not sure why you?d need GRPN for that ? processing I guess?).? I can see $YELP possibly leveraging some synergistic angle with advertising and or a deals-based company like $GRPN.

But I can?t see how Instagram makes any money. Ever.? We already had a monstrous bubble based on the ?eyeballs? valuation metric.? How?d that work out?

So is it different this time?? As Twitter user @ddd responded to my Tweet above: ?nope, they paid a billion bucks for the place people choose to spend their time doing that.? ?? As I said, I lived through the first internet bubble which was based on this kind of thinking, so let me just go to the Tech experts who know this business much better than I do.

Dan Frommer @ SplatF:

?The biggest threat to Facebook is a mobile-only or mobile-first social network that captures the increasing amount of time spent on smartphones in a way Facebook can?t or doesn?t.

In my experience, that?s exactly what Instagram does. I?m still addicted to Facebook on the old desktop-browser web, but when I?m on my phone, I gravitate to Twitter and Instagram. Path is another example, but Instagram is more developed ? that?s the deal I?d make, too.?

Alexia Tsotsis @ Techcrunch:

?Many are comparing this buy to Google?s $1.65 billion acquisition of YouTube, which makes sense from both a user and vertical integration stand point. Facebook, which was rumored to be building its own standalone photosharing, is well aware that much of the ?stickyness? of the platform revolves around photosharing, especially via mobile.?

Om Malik @ GigaOm:

?My translation: Facebook was scared shitless and knew that for first time in its life it arguably had a competitor that could not only eat its lunch, but also destroy its future prospects. Why? Because Facebook is essentially about photos, and Instagram had found and attacked Facebook?s achilles heel ? mobile photo sharing.?

Congrats to the crew at Instagram ? I mean that ? it?s an impressive feat when you can build a billion dollar business with no regards to revenue.?? Amazing.

I do wonder, however, if after closing the Facebook deal anyone at Instagram privately uttered my favorite line: Sold to you, SUCKA.

Artist Thomas Kinkade dies at 54; 'Painter of Light' worked to project ...

Thomas Kinkade unveils his painting 'Prayer for Peace' at a 2006 exhibit. (AP)

By KIM CHRISTENSEN

Thomas Kinkade, the self-styled ?Painter of Light? who died Friday at 54, once said he worked to ?create images that project a serene simplicity.? But despite his astonishing commercial success with luminous seascapes and paintings of cottages and street scenes, Kinkade?s life in many ways was neither serene nor simple.

Millions of his paintings and prints hang in homes around the world, popularity that translated to more than $50 million in earnings for the artist from 1997 to 2005 alone. Lauded for his generosity, he once gave an Anaheim widow $25,000 worth of his art to replace what she?d lost in a fire.

?He lived life to the fullest,? said Ken Raasch, his former business partner who co-founded Kinkade?s company more than 20 years ago. ?He was a very eclectic character, an amazing artist who was not a stereotypical man in any sense. He created his own mold, I?d say, and I think we were all blessed because of that.?

Sign our online guest book | Photos: 2012 Notable Deaths

Kinkade?s fame and fortune, however, were complicated by personal and business struggles.

In the last decade he had been locked in legal battles with former Thomas Kinkade Signature Gallery owners, some of whom accused him in lawsuits of trading heavily on his Christian beliefs even as he drove them to financial ruin.

He had battled alcohol abuse, former business associates said in court records and interviews, and in 2010 his mug shot went viral after his arrest on a drunken driving charge to which he later pleaded no contest.

And for more than a year, Kinkade had been separated from his wife, Nanette, with whom he had four daughters.

?The Thomas Kinkade story and legacy is a story of triumph and tragedy, which I believe that everyone can gain from paying attention to,? said Terry Sheppard, a former Kinkade friend and company vice president who parted ways with the painter in 2003.

Kinkade died Friday at his home in Monte Sereno, an affluent enclave near Los Gatos in the Bay Area. His family attributed his death to natural causes. The Santa Clara County coroner planned to conduct an autopsy Monday.

?Thom provided a wonderful life for his family,? his wife, Nanette Kinkade, said in a statement. ?We are shocked and saddened by his death.?

In addition to his wife, he is survived by their daughters, Merritt, Chandler, Winsor and Everett, and a brother, Pat, who worked for Kinkade?s company.

On Saturday, Thomas Kinkade Co. officials sent a message to distributors that the business will continue, saying that ?his art and powerful message of inspiration will live on.?

He was born William Thomas Kinkade III in 1958 in Sacramento County and often said he was the product of a broken home and a rough childhood.

Kinkade once worked as a film animator and sold his paintings in supermarket parking lots in his hometown of Placerville. More than two decades ago, he and his wife spent their life savings to start his printmaking business.

Since then, Kinkade became wealthy painting his romantic, idealized images of landscapes, lighthouses and country cottages with windows aglow. His images also have adorned air fresheners, night lights, teddy bears, toys, pillows andLa-Z-Boyloungers.

Some critics have dismissed Kinkade?s works ? with titles such as ?Silent Night? and ?The Garden of Prayer? ? as mass-produced kitsch. But that has not kept legions of admirers from paying from as little as $99 for a print to $10,000 or more for canvas editions signed and retouched by the artist.

Karen de la Carriere, a Los Angeles dealer who specializes in Internet resales of Kinkade?s work, said her business ?spiked like never before? after Kinkade died.

In a 2006 Times interview, she had likened Kinkade to ?a modern-day Leonardo da Vinci or Monet.? On Saturday, De la Carriere said that she would remember him for his talent and charitable works.

?A lot of people try to slime Thom, saying his art is just mass-produced for the money,? she said. ?But Thom had a really generous side. I knew a lady whose entire house burned down. When he found out about it and that she was ? a widow who had lost her nine Kinkade images, he replaced them.?

Others? memories of Kinkade, touted as one of America?s most widely collected artists, are harsher.

In 2006, an arbitration panel ordered Kinkade?s company, then called Media Arts Group, to pay $860,000 for defrauding the former owners of two failed Virginia galleries. The lawsuit, like those brought by other failed dealers, alleged that the company had used Kinkade?s religious faith to draw them into the business, and then stuck them with unsalable merchandise and forced them to open stores in markets that couldn?t sustain them.

The fraud finding did not single out Kinkade but said that he and others at the company created ?a certain religious environment? designed to get prospective gallery owners to trust the company.

The $860,000 award was later increased to $2.8 million to cover interest and legal fees.

Kinkade agreed to pay the award after moving vans hired by the plaintiff?s lawyer, Norman Yatooma, showed up at one of Kinkade?s companies, Pacific Metro, threatening to take artwork to satisfy the judgment. The company had made one $500,000 payment and was due to pay an additional $1 million when it abruptly filed for bankruptcy protection, halting further payment. A new payment plan was worked out in the bankruptcy, Yatooma said Saturday.

?Running a charity that supports fatherless kids, and as a father of four daughters myself, my heart sincerely breaks for Thomas Kinkade?s family,? he said. ?My heart also breaks for the lives of the countless other families that Thomas Kinkade?s company has devastated. Regrettably, my perspective of Thomas Kinkade was much more of a misled businessman than an accomplished painter.?

In sworn testimony and interviews with The Times, former gallery owners and ex-employees recounted incidents that made Kinkade?s personal behavior appear at odds with his Christian image.

The recollections included an allegedly drunken Kinkade heckling illusionists Siegfried & Roy in Las Vegas and cursing a woman who tried to help him when he fell from a bar stool.

The artist later accused ?disgruntled ex-dealers? of launching ?media attacks? on him. But he also said he might have behaved badly during a stressful time that he had since put behind him.

He also once testified the he was not perfect, and never claimed to be.

?Book of Ecclesiastes says enjoy yourself, have a glass of wine, for this is God?s will for you,? he said. ?It?s never consistent with God?s will that we behave in a sinful way; however, God also loves us and accepts us and understands that at times we have our failings.?
